By downloading, installing, accessing, or using Voice Translation App (the "App"), you agree to be bound by these Terms of Use. If you do not agree, do not download, install, access, or use the App.
This agreement is between you and the developer identified as the "Seller" in this app's App Store listing ("Developer," "we," or "us") only, and not with Apple. Apple is not responsible for the App or its content, maintenance, support, warranties, or any claims relating to it, except as required by applicable law.
You represent that you have the legal capacity to enter into this agreement. If you use the App on behalf of a company or other entity, you represent that you have authority to bind that entity to these Terms.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for lawful personal purposes on Apple-branded devices you own or control, as permitted by Apple's usage rules.
The App is intended for good-faith personal use. Excessive use — currently defined as more than 120 minutes of cumulative translation time in a calendar month — may be limited, including by lowering performance, to maintain service quality and availability for all users. We may adjust this threshold at any time.
You are solely responsible for your use of the App, and for determining whether that use is lawful in your location, the location of any other person involved, and any location where content is stored, sent, or accessed.
The App captures, processes, translates, and may temporarily store voice, audio, and text you provide, in order to deliver translation and transcription features. Before using any recording or live-translation feature, you must obtain any notice, permission, or consent required by law from every person whose voice or communications will be recorded, processed, translated, or transcribed through the App.
Recording and consent laws vary by state and province. Some jurisdictions require the consent of only one party to a conversation; others require the consent of every party. You are solely responsible for complying with the law that applies to you, wherever you are using the App. If you are uncertain whether consent is required, do not use the recording features until you have obtained it.
These Terms currently address use of the App within the United States and Canada. We do not represent that use of the App is lawful in any other country or for any particular purpose.
The App may produce inaccurate, incomplete, delayed, or culturally inappropriate translations or transcriptions, affected by accents, background noise, connection quality, or the limits of the underlying technology. Review translations independently before relying on them.
The App is not intended for emergency, medical, legal, immigration, or other situations where an inaccurate translation could cause serious harm.
You must not use the App for any unlawful, harmful, harassing, discriminatory, or infringing purpose, including unauthorized recording or surveillance, interception without required consent, or violation of anyone's privacy rights.
You represent that you own or control all rights necessary to submit and process any audio, text, or content you provide through the App, and that doing so does not violate anyone else's rights.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP.
OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS BEFORE THE CLAIM, OR US$50.
Nothing in these Terms excludes liability, or limits any consumer right, that cannot be excluded or limited under applicable law.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU RELEASE US FROM ANY CLAIMS ARISING FROM YOUR USE OR MISUSE OF THE APP, YOUR FAILURE TO OBTAIN REQUIRED RECORDING CONSENT, OR ANY DISPUTE BETWEEN YOU AND A THIRD PARTY CONNECTED TO CONTENT YOU PROCESSED THROUGH THE APP.
PLEASE READ THIS SECTION CAREFULLY. To the maximum extent permitted by applicable law, any dispute arising from these Terms or the App will be resolved by final, binding individual arbitration, except that either party may bring a qualifying claim in small claims court. By accepting these Terms, you and we waive the right to a jury trial, except where such a waiver is prohibited by law.
Enforceability of arbitration clauses varies by province in Canada and by state in the U.S.; this section applies only to the extent permitted where you live.
To the maximum extent permitted by law, claims may be brought only on an individual basis, not as part of any class, collective, or representative action.
We may suspend or terminate your access to the App at any time, for any reason, including suspected misuse or violation of these Terms.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles, except where mandatory local consumer law requires otherwise.
These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the App. If any provision is found unenforceable, the rest remains in effect.
